These terms are an agreement between you and Point Ginkgo ("we", "us"), the operator of Witnist. By creating an account or using Witnist you agree to them. If you do not agree, do not use the service.
You must be at least 18 years old to use Witnist. We verify date of birth at registration. You are responsible for keeping your account credentials secure and for activity on your account.
Witnist is currently offered as a beta. Features may change, break, or be removed, and content or accounts may occasionally need to be reset. We will make reasonable efforts to preserve your content but cannot guarantee it during the beta.
You own the content you post. So that we can operate the service, you grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, and display your content — solely to provide and improve Witnist, and only to the audience your visibility settings allow. The license ends when you delete the content or your account, except for limited retention described in our Privacy Policy.
Witnist exists so that what you see was really witnessed. Public posts must be captured with the in-app camera at the location where they are pinned. Uploading existing images, AI-generated media, or misrepresenting where or when a photo was taken in public content violates these terms.
The community guidelines in the app (Settings → Safety → Community Guidelines) are part of these terms. In short, do not post or do anything that is illegal, that harasses or threatens people, that contains nudity or sexual content, that glorifies violence, that is spam or deceptive, or that reveals someone else's private information or location without their consent. Do not interfere with the service, scrape it, or attempt to access accounts or data that are not yours.
You can report content or accounts in the app. We review reports and may remove content, restrict visibility, or suspend or terminate accounts that violate these terms — with or without notice, depending on severity. If your account is suspended, you may contact [email protected].
You may stop using Witnist and delete your account at any time in Settings. We may suspend or terminate accounts as described above, or discontinue the service (with reasonable notice where practical).
Witnist is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, non-infringement, or that the service will be uninterrupted or error-free.
To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, or lost data, arising from your use of the service. Our total liability for any claim relating to the service is limited to the greater of US$100 or the amount you paid us in the twelve months before the claim (currently US$0 — the beta is free).
You agree to indemnify us against claims arising from content you post in violation of these terms or from your unlawful use of the service.
These terms are governed by the laws of the United States and of the U.S. state in which Point Ginkgo is established, without regard to conflict-of-law rules.
We may update these terms. If we make material changes we will update this page and the effective date and note the change in the app. Continuing to use Witnist after a change means you accept the updated terms.
